Fines for OnlyFans: Models in Ukraine Are Winning Court Cases for Millions of Hryvnias

In at least 27 court cases, OnlyFans models were able to partially or fully overturn fines imposed by the State Tax Service.

It was noted that in 92% of the cases lost by the tax authorities, the reasons were procedural violations, lack of evidence, and letters sent to outdated addresses.

As a result, many audits were canceled, and with them, the assessed tax liabilities.

The State Tax Service often initiated audits based on information from British tax authorities regarding payments from Fenix International Ltd, which operates the OnlyFans platform. However, the courts note that letters not supported by contracts, bank statements, or other documentation of accruals does not constitute sufficient proof of income. 

The current situation is as follows:

• Odesa region: 8 cases won
• Dnipropetrovsk: 5
• Kyiv: the largest canceled fine of over 3 million UAH, which was imposed by the State Tax Service based on allegedly received income of approximately $400,000. However, the plaintiff provided bank documents that did not confirm this, and the court ruled in her favor.
